Terms & Conditions

Review the contractual framework, design milestones, deliverable schedules, intellectual property rights, and client responsibilities that guide every architectural commission at YAN Studio.

1. Acceptance of Terms & Practice Scope

Welcome to YellowAntNest Studio ("YAN Studio"). These Terms & Conditions govern the architectural design, interior spatial planning, 3D visualization, structural design consultation, and site advisory services provided by YAN Studio, whether commissioned online via our platform or through direct studio consultation in Bangalore, Karnataka.

By engaging YAN Studio, submitting an inquiry, approving a design proposal, or downloading architectural drawing deliverables, you acknowledge that you have read, understood, and agreed to be legally bound by these terms.

Distinction of Roles: YAN Studio provides architectural and engineering design consultancy. Unless explicitly commissioned under a separate turnkey construction agreement, YAN Studio does not act as the civil general contractor or physical labor provider.

2. Architectural Milestones & Deliverables

To maintain transparency and structural rigor, residential projects proceed through structured sequential milestones. Progress to each subsequent stage requires formal client approval and milestone clearance:

  • •Stage 1 · Concept Planning & Site Zoning: Site orientation evaluation, functional bubble diagrams, zoning, and preliminary 2D conceptual floor plans tailored to family requirements and plot geometry.
  • •Stage 2 · Schematic Design & 3D Massing: Refinement of selected floor plans, exterior facade elevations, volumetric studies, window/door placements, and preliminary 3D architectural visualizations.
  • •Stage 3 · Municipal Sanction Drawings: Preparation of regulatory drawing sets adhering strictly to municipal bye-laws (BBMP, BDA, BMRDA, etc.) required for client submission to local authorities.
  • •Stage 4 · Working & Good-for-Construction (GFC) Drawings: Detailed architectural construction drawings, structural framing layouts (columns, footings, beam reinforcement), electrical layouts, plumbing schematics, and door/window schedules.

3. Revisions & Scope Boundaries

Each design phase includes up to two (2) rounds of standard iterations within the agreed project brief. We encourage clients to consolidate feedback to keep project timelines on schedule.

What Constitutes an Out-of-Scope Modification? Modifications requested after a milestone has received written sign-off (e.g., requesting structural grid alterations after GFC drawings have been issued), fundamentally changing the building footprint, adding additional floor levels, or relocating core wet areas will be treated as an addendum subject to supplementary billing.

4. Client Obligations & Site Data

Accurate design relies on correct baseline property records. The client agrees to furnish:

  • •Accurate Boundary Surveys: Total station survey or cadastral survey showing precise corner coordinates, road width, and any encumbrances or utility poles.
  • •Soil Investigation Reports: Geotechnical soil test reports required by our structural engineers to safely design foundations.
  • •Timely Reviews: Client approvals and milestone confirmations within 7 to 10 working days of drawing submission to maintain project momentum.
  • •Site Access & Safety: Safe, unrestricted access to the plot for our architects and engineers during scheduled field inspections.

5. Intellectual Property & Single-Use Build License

All architectural drawings, concept sketches, CAD models, BIM data, 3D renderings, and specifications prepared by YAN Studio are the intellectual property of YAN Studio, protected under Indian Copyright laws.

Upon receipt of full payment for the designated milestone, the client is granted a non-exclusive, non-transferable, single-use license to construct the residence strictly on the specified property plot. Blueprints may not be resold, reused on different sites, duplicated for speculative housing projects, or assigned to third-party developers without prior written consent from YAN Studio.

6. Professional Fees, Billing & Invoicing

Professional fees are computed based on the built-up area (per square foot rate) or a stipulated lump-sum agreement as detailed in your project proposal.

  • •Advance Commitment: A mobilization fee is payable prior to initiating Stage 1 conceptual layouts.
  • •Milestone Payments: Fees are billed progressively at the completion of each sequential stage.
  • •Taxes & Statutory Levies: All professional fee invoices are subject to Goods and Services Tax (GST 18%).
  • •Payment Timeline: Invoices are payable within 10 days of issuance to prevent design pauses.

7. Site Visits & Construction Review

Where included in your service tier, YAN Studio conducts periodic architectural quality review visits at critical construction stages (e.g., foundation setting, column marking, slab casting, masonry review, and electrical/plumbing conduit inspections).

Advisory Nature: Architectural site visits verify visual adherence to the architectural design intent. They do not constitute full-time day-to-day site supervision. The general contractor remains solely responsible for construction methods, workplace safety, material batch testing, and structural execution quality.

8. Municipal Approvals & Statutory Sanctions

YAN Studio prepares sanction drawing sets compliant with governing building bye-laws (BBMP, BDA, BMRDA, etc.). However, statutory plan sanctions, physical clearances, water/sewerage connections, and electricity board approvals depend on governmental bodies and statutory processing timelines outside our direct control.

9. Project Suspension & Termination

Either party may terminate the agreement upon fourteen (14) days written notice. In the event of client-requested suspension or termination, fees for all stages completed or underway up to the date of notice shall be settled based on actual work delivered.

Advance mobilization fees cover initial research, zoning, and client consultations and are non-refundable once concept design drafting has commenced.

10. Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these terms shall first be resolved through amicable mediation.

Failing amicable settlement within 30 days, disputes shall be referred to arbitration in Bangalore, Karnataka, in accordance with the Arbitration and Conciliation Act, 1996. The courts of Bangalore, Karnataka shall have exclusive jurisdiction.
